Manila, Philippines – The Supreme Court (SC) has recalled its resolution on the case involving the alleged illegal retrenchment of 1,400 flight attendants of flag carrier Philippine Airlines (PAL) where it ruled with finality that it was illegal.
In an en banc resolution dated October 4, the High Court took cognizance of a letter from PAL legal counsel Estelito Mendoza questioning the composition of the SC 2nd Division that handed down the earlier resolution dated September 7.
Mendoza’s letter pointed out that it should have been the High Court’s 3rd Division, not the 2nd Division, that should have passed upon the case.
“The Court En Banc resolves to accept G.R. No. 178083 (Flight Attendants and Stewards Association of the Philippines (FASAP) v. Philippine Airlines Inc. (PAL), Patria Chiong, et al.) and to take cognizance thereof.
The Court En Banc further resolves to recall the resolution dated September 7, 2011 issued by the Second Division in this case,” the en banc resolution read.
