For the third time, Congress, in a joint session Wednesday, granted President Duterte’s request to extend martial law and suspend the Writ of Habeas Corpus in Mindanao from Jan. 1, 2019 to Dec. 31, 2019.
After more than three hours of deliberations, 235 members of Congress voted in favor of the martial law extension. Twenty-eight voted against and one abstained – Sen. Ralph G. Recto.
The Senate voted 12-5-1 while the House of Representatives voted 223-23.
House Majority Leader and Camarines Sur Rep. Rolando Andaya Jr. moved that Congress resolve to extend the period of Proclamation No. 216 and suspending the privilege of the Writ of Habeas Corpus in Mindanao for another period of one year from Jan. 1, 2019 to Dec. 31, 2019 for the House of Representatives.
Senate Majority Leader Juan Miguel Zubiri moved on the part of the Senate.
“The further extension of martial law and the suspension of the privilege of the Writ of Habeas Corpus will enable the AFP, PNP, and all other law enforcement agencies to finally put an end to the ongoing rebellion, continue to prevent the same from escalating in other parts of the country, and hopefully avoid a catastrophe similar to what happened in Marawi City,” Andaya said.
Executive Secretary Salvador Medialdea cited the continuing “actual rebellion” as reason behind the proposed extension of martial rule in the southern Philippines.
“Actual rebellion still clearly persists in Mindanao. Public safety necessitates further extension of the martial law period and the suspension of the Writ of Habeas Corpus,” he said.
He noted that the Chief Executive is seeking another extension of martial law upon an extensive personal evaluation of the current situation in Mindanao and taking into account the security assessments from the Department of National Defense and the Armed Forces of the Philippines, among others.
In his letter to Senate President Vicente C. Sotto III and House Speaker Gloria M. Arroyo dated Dec. 6, President Duterte asked Congress to extend the martial law proclamation and the suspension of the privilege of the Writ of Habeas Corpus in Mindanao from Jan. 1, 2019 to Dec. 31, 2019.
“We cannot turn a blind eye that Mindanao is still in a midst of rebellion. There may have been a significant decimation of local and foreign groups in Marawi City, a weakening of communist terrorist groups’ and local terrorist groups’ capability in the entire Mindanao, and a reduction of atrocities that translated to notable economic gains,” Medialdea said.
Senate Minority Leader Franklin M. Drilon rejected the martial law extension, pointing out “there was no other detailed report of subsisting rebellion” other than those submitted during the executive briefing.
“There is no ground, no actual armed uprising that is taking place in Mindanao to justify the extension of martial law,” said, citing that President Dueterte’s Proclamation 216 is premised on Marawi City siege.
He also stressed that “we cannot make martial law as the instrument to make governance more effective.”
