WHEN President Marcos declared martial law in 1972, he drew his authority from Article VII, Section 11(2) of the 1935 Constitution which provided in part: “… In case of invasion, insurrection, or rebellion, or imminent danger thereof, when the public safety requires it, he may suspend the privilege of the writ of habeas corpus, or place the Philippines or any part thereof under martial law.”

At the start of the Supreme Court’s hearing of oral arguments on the issue of whether to allow the burial of the remains of former President Ferdinand E. Marcos at the Libingan ng mga Bayani, Justice Teresita Leonardo de Castro remarked: “I think it is the name that creates controversy.” She was referring to the name of the cemetery “Libingan ng mga Bayani.”
