The Department of Justice (DoJ) has started filing charges against Iloilo 1st District Rep. Janette Garin, former health secretary, and her co-respondents over alleged liability in the deaths of eight children who got inoculated with anti-dengue vaccine Dengvaxia.
“We started filing charges in various courts,” said Senior Deputy State Prosecutor Richard Anthony Fadullon.
A panel of prosecutors found probable cause to charge Garin and her co-respondents with reckless imprudence resulting imprudence in homicide under the Revised Penal Code (RPC).
The move came following the conduct of a preliminary investigation on the second batch of Dengvaxia complaints involving the deaths of eight children –Roshaine Carino, Christine Joy Asuncion, Clarissa Alcantara, Erico Mendoza Leabres, Christine Mae de Guzman, John Paul Rafael, Michael Tablate, and Naomi Nimura.
The panel also found probable cause to indict executives of Dengvaxia manufacturer and pharmaceutical firm Sanofi Pasteur, namely president Carlito Realuyo and board members Stanislas Camart, Jean Louis Grunwald, Jean-Francois Vacherand, and Conchita Santos for defective products under Article 97 of the Consumer Act of the Philippines.
Probable cause was also found to indic t Realuyo with mislabeling drugs in violation Article 89 of the Consumer Act of the Philippines. (Jeffrey Damicog)
